TERMS AND CONDITIONS OF USE
1. DEFINITIONS AND TERMS
MobilierModern.RO- S.C. NOARIM GROUP S.R.L., with registered office in Str. STR. 23 AUGUST, NR.94, MUN. TARGU JIU, JUD. GORJ, registered at the Trade Register under no. J18/877/2006, tax code RO 1975471, share capital 200 ron.
Seller – MobilierModern.RO
Website – https://mobiliermodern.ro and its subdomains
Buyer – an individual/legal entity or any legal entity that creates an account on the Site and places an Order.
User – any natural/legal person registered on the Site, who, by completing the Account creation process, has agreed to the site-specific terms in the General Terms and Conditions section.
Nickname – a pseudonym by which a particular User/Customer/Buyer can add Content to the Site. The Nickname is associated with the User/Customer/Buyer’s information on the Site under the name “User Name”.
Customer – natural person / legal entity who has or obtains access to the CONTENT, by any means of communication made available by MobilierModern.RO (electronic, telephone, etc.) or on the basis of a user agreement existing between MobilierModern.RO and the latter and requiring the creation and use of an ACCOUNT.
Goods and Services – any product or service, including the documents and services mentioned in the Order, to be supplied by the Seller to the Buyer as a result of the Contract.
Order – an electronic document that occurs as a form of communication between the Seller and the Buyer whereby the Seller agrees to deliver the Goods and Services and the Buyer agrees to receive those Goods and Services and to make payment for them.
Campaign – the act of displaying for commercial purposes a finite number of Goods and/or Services having a limited and predefined stock for a period of time set by the Seller.
Account – the section of the Site consisting of an e-mail address and a password that allows the Buyer to submit Orders and that contains information about the Customer/Buyer and the Buyer’s history on the Site (Orders, tax invoices, Goods warranties, etc.).
Contract – means a distance contract as defined in GEO 34 of 4 June 2014 concluded between the Seller and the Buyer without the simultaneous physical presence of the Seller and the Buyer.
Content
– all information on the Site that can be visited, viewed, or otherwise accessed through the use of electronic equipment;
– the content of any e-mail sent to the Buyers by the Seller by electronic means and/or any other available means of communication;
– any information communicated by any means whatsoever by an employee/collaborator of the Seller to the Buyer, whether or not in accordance with contact information specified by the Buyer;
– information relating to the Goods and/or Services and/or the rates charged by the Seller in a given period;
– information relating to the Goods and/or Services and/or the rates charged by a third party with whom the Seller has partnership agreements in a given period;
– data relating to the Seller, or other privileged data of the Seller.
Intellectual Property Rights (hereinafter IPR) – all material rights such as know-how, copyright and rights in kind of copyright, database rights, design rights, design rights, patents, trademarks and domain name registrations for any of the above.
Review – a written evaluation by the owner or recipient of a product or service, written on the basis of personal experience and ability to make qualitative comments and to say whether or not the product or service meets the specifications stated by the manufacturer.
Rating – a way of expressing a User/Customer/Customer’s satisfaction with a product. The rating is expressed in the form of stars, and each product can receive a score from one star to five stars. This satisfaction rating will always be associated with the User/Customer/Customer’s written review of a product or service.
Comment – a critical assessment or observation on a Review or other comment.
Inquiry – a form of address to other Users/Customers/Buyers in order to obtain information about the products or services on that page.
Answer – written information that is sent to the User/Customer/Buyer who has asked a question on the Site, on a specific product page. The answer is an explanation given by one User/Customer/Customer to another User/Customer/Customer in a discussion.
Document – these Terms and Conditions.
Newsletter – means of regular information, exclusively electronic, i.e. electronic mail (e-mail, SMS) on the Goods and Services and/or promotions carried out by the Seller in a given period, without any commitment on the part of the Seller with reference to the information contained therein.
Transaction – the collection or reimbursement of an amount resulting from the sale of a Good and/or Service by MobilierModern.RO to the Buyer, using the services of the card processor agreed by the Seller, regardless of the method of delivery.
Specifications – all specifications and/or descriptions of the Goods and Services as specified in the Order.
2. GENERAL
Placing an order with S.C. NOARIM GROUP S.R.L. constitutes your agreement to the terms and conditions of this Document.
The information provided to S.C. NOARIM GROUP S.R.L. is used only for the purpose for which it was entered (placing orders), in accordance with the laws in force. S.C. NOARIM GROUP S.R.L. does not provide your e-mail address to third parties, does not block spam and does not make public the data provided by its customers without their explicit consent. Any user has the possibility to delete the e-mail address provided from the database.
All prices shown on the website are in RON and include VAT (19%). Due to the large amount of information and the conditions imposed by suppliers, the characteristics and availability of the products presented on this site may change without prior notice.
Discounts, rebates and promotions are not cumulative. Always keep the discount with the highest value.
For orders paid with a gift card, if there are active promotional campaigns on the site, the discount will be applied with the help of our customer service colleagues at the phone number 0xxxxxxxxxxxx or at the e-mail address clienti@mobiliermodern.ro.
A deposit of at least 50% of the value of the product may be required for the purchase of products produced to order.
In the case of Goods that undergo changes at the Buyer’s request (e.g. atypical mattress dimensions: width, length, height, etc.), the return of the Goods is not accepted.
Price, payment method and payment term are specified in the order. S.C. NOARIM GROUP S.R.L. will issue an invoice to the Buyer for the Goods and services delivered, the Buyer’s obligation being to provide all the necessary information to issue the invoice according to the legislation in force.
We reserve the right to cancel orders that are incomplete or made without basic information (e.g. buyer name, contact phone, email address, delivery address, billing address, payment method).
If a product is listed with an incorrect price or incorrect information due to typographical errors or errors in pricing or product information received from suppliers, we reserve the right to refuse or cancel any orders placed for products that are in error. We shall have the right to refuse or cancel any order even if it has been paid for in advance. In this case the money will be returned as soon as possible.
We reserve the right to change discounts, rebates and promotions without prior notice.
The products sold through www.mobiliermodern.ro are new, sold in their own packaging or resealed (in this case the reason why the product has been resealed is clearly stated) and are accompanied by a tax invoice and guarantee certificate at the time of delivery.
S.C. NOARIM GROUP S.R.L. reserves the right to refuse cooperation with customers who show inappropriate behavior and language (aggressive, licentious, etc.) or have a history of refused orders.
S.C. NOARIM GROUP S.R.L. reserves the right to modify both the content and the structure of the website at any time and without prior notice.
This website uses its own and third-party cookies to provide visitors with a much better browsing experience and services tailored to their needs and interests. When you visit mobiliermodern.ro, a cookie belonging to us is stored in your browser.
As you browse https://mobiliermodern.ro, advertising cookies will be placed on your computer so that we can understand what you are interested in.
The products sold by https://mobiliermodern.ro can only be delivered on the basis of an online order. Ordering online does not imply reserving products. Online orders will be fulfilled in the chronological order in which they were registered by the system. An order containing a product with the status: In Stock, cannot be fulfilled if another order for the same product has been registered chronologically before it and subsequently confirmed, thus depleting the stock.
3. ONLINE SALES POLICY
Access to place an Order is granted to any Customer/Buyer.
For justified reasons MobilierModern.RO reserves the right to restrict the Customer’s / Buyer’s access to place an Order and/or to some of the accepted payment methods, if it considers that, based on the Customer’s / Buyer’s conduct or activity on the Site, his/her actions could in any way prejudice MobilierModern.RO. In any of these cases, the Customer/Buyer may contact the Customer Relations Department of MobilierModern.RO to be informed of the reasons that led to the application of the above-mentioned measures.
Communication with the Seller can be done through direct interaction with the Seller or through the addresses mentioned in the “contact” section of the Site. The seller is free to handle the information received without having to justify it.
MobilierModern.RO may publish on the Site information about Goods and/or Services and/or promotions offered by MobilierModern.RO or by any other third party with which MobilierModern.RO has entered into partnership agreements, within a certain period of time and within the limit of available stock.
All prices for Goods and/or Services presented on the Site are expressed in lei (RON) and include VAT.
In the case of online payments the Seller is/cannot be held responsible for any other additional costs incurred by the Buyer, including but not limited to currency conversion fees applied by the bank issuing the Buyer’s card, if the currency of issue differs from RON. Responsibility for this action rests solely with the Buyer.
All information used to describe the Goods and/or Services available on the Site (static / dynamic images / multimedia presentations / etc.) does not represent a contractual obligation on the part of the Seller and is used for presentation purposes only.
After 3 ( three ) days after the purchase of a Good or Service, the Buyer will be asked to enter a Review related to the purchased Good or Service. The request will be sent to the email address registered by the Buyer in the Account. In this way, the Buyer contributes to informing other potential Users/Customers/Buyers on the Site and is actively involved in the development of new Services and in detailing as fully as possible the characteristics of the Goods.
4. CONTRACTUAL DOCUMENTS
By placing an order electronically, by telephone, chat or directly in physical stores on https://mobiliermodern.ro, the Buyer agrees to the form of communication (telephone, chat or e-mail) through which S.C. NOARIM GROUP S.R.L. carries out its operations.
The order is composed as follows:
- The order (together with clear indications of delivery and invoicing dates) and its specific conditions;
- Buyer’s specifications (where applicable);
The notification received by the Buyer after the Order has been placed is for information purposes only and does not constitute acceptance of the Order. This notification is made electronically (e-mail) or by telephone.
If the Seller confirms the order, this will imply the Buyer’s full acceptance of the terms and conditions of the order. Acceptance of the order by the Seller shall be deemed completed when there is a verbal or electronic confirmation from the Seller to the Buyer, without requiring an acknowledgement of receipt from the Buyer.
This Contract shall enter into force upon confirmation of the order by the Seller. Confirmation is done by telephone, electronically or verbally. The general terms and conditions of sale will be the basis of the Contract thus concluded, in addition to them being the Guarantee Certificate issued by S.C. NOARIM GROUP S.R.L. or one of its suppliers.
For justified reasons, the Seller reserves the right to change the quantity of Goods and/or Services in the Order. If it changes the quantity of Goods and/or Services in the Order, it will notify the Buyer at the e-mail address or telephone number provided to the Seller at the time of placing the Order and refund the amount paid.
The contract shall be deemed to be concluded between the Seller and the Buyer upon receipt by the Buyer from the Seller, via e-mail and/or SMS, of the notification of dispatch of the Order.
5. COMMENT
The Customer/Buyer may place Orders on the Site, by adding the desired Goods and/or Services to the shopping cart and completing the Order by making payment by one of the methods expressly indicated. Once added to the shopping cart, a Good and/or Service is available for purchase to the extent that there is stock available for it. The addition of a Good/Service to the shopping cart, in the absence of the completion of the Order, does not entail the registration of an order, nor the automatic reservation of the Good/Service.
By completing the Order, the Buyer agrees that all data provided by the Buyer necessary for the purchase process is correct, complete and true at the time of placing the Order.
By completing the Order, the Buyer consents that the Seller may contact the Buyer, by any means available / agreed by the Seller, in any situation where it is necessary to contact the Buyer.
The Seller may cancel the Order placed by the Buyer, upon prior notice to the Buyer, without any further obligation of either party to the other or without either party being entitled to claim damages against the other in the following cases:
– non-acceptance by the Buyer’s card-issuing bank of the transaction in the case of online payment;
-invalidation of the transaction by the card processor approved by MobilierModern.RO, in case of online payment;
– the data provided by the Client/Buyer on the Site are incomplete and/or incorrect;
If the Customer/Buyer requests withdrawal from the Contract within the legal withdrawal period, the Customer/Buyer must also return any gifts that accompanied the product. If the Order is paid for, the Seller shall refund the amount within 14 (fourteen) days from the date the Buyer informs the Seller of its decision to withdraw from the Contract. The amount will be returned as follows:
-for orders paid by card online ->by refunding to the account from which the payment was made;
-for orders paid by Op/refund/iTransfer/bank card-> by bank transfer;
Some of the products benefit from certain discounts/bonuses when purchased in the same order with another product. These discounts can also be seen in the order confirmation received by the customer and are distributed by value on the basket of products included in the promotion.
The promotion is only valid if the customer keeps the order with the originally chosen product package. If they give up one of the products in the package, the promotion is no longer valid and the discount applied is cancelled. The product for which the customer retains the option to order is returned at the full price, which is the price paid when the order is fulfilled.
If a customer wishes to return a product that has been discounted or has generated an additional bonus at the time of purchase, by placing it in the order in combination with other products, the following refund rules apply:
5.1 The money will be returned within 14 days from the date of the return decision to the bank account provided by the customer in the return form.
5.2 Because the product was part of a promotion, only by associating it with the other products, the discounts/bonuses offered in the original order are cancelled. The prices of the products kept by the customer will revert to the value before the discount was applied, a discount obtained by associating the product to be returned with the order. The amount to be returned to the customer is equal to the difference between the amount paid by the customer and the original price of the retained products (without the discount applied for product cumulation).
5.3 If a customer has paid by card in instalments, the amount to be refunded shall comply with the conditions in point 5.2 and the money shall be refunded only to the account of the card on which the instalment payment was made.
The seller may postpone reimbursement until receipt of the Goods sold or until receipt of proof that they have been dispatched, if he has not offered to collect the Goods himself (whichever is the later).
If a Good and/or Service ordered by the Buyer cannot be delivered by the Seller, the Seller shall inform the Customer/Buyer of this fact and shall return to the Buyer’s account the consideration for the Good and/or Service within a maximum of 7 (seven) days from the date on which the Seller became aware of this fact or from the date on which the Buyer expressly expressed its intention to terminate the Contract.
5.4 For all orders placed on https://mobiliermodern.ro, the customer can benefit from free storage of the products for 120 days, provided they are paid in full. The maximum storage period of an order is 120 days from the moment of receipt of the order.
5.5 Bonus products (e.g.: sheets, pillows, pillowcases, covers, etc.) are only offered for those products that have specified in the product title the respective mention (e.g.: Deluxe Mattress + Pillow). Bonus products will appear in your shopping cart with the specification * Product offered as a gift.
6. INTELLECTUAL PROPERTY RIGHTS
The content of the website https://mobiliermodern.ro, as defined in the preamble – texts, images, web graphics, scripts, programs, databases, as well as the materials that are the subject of email communications – belongs to S.C. NOARIM GROUP S.R.L. and is protected by copyright law and the law on intellectual and industrial property rights.
The Customer/Buyer is not permitted to copy, distribute, publish, transfer to third parties, modify and/or otherwise alter, use, link to, display, include any Content in any context other than that originally intended by MobilierModern.RO, include any Content outside of the Site, remove any markings indicating MobilierModern.RO’s copyright in the Content, or participate in the transfer, sale, distribution of any material made by reproducing, modifying or displaying the Content, except with the express written consent of MobilierModern.RO.
Customer/Buyer may copy, transfer and/or use the Content only for personal or non-commercial purposes, provided they do not conflict with the provisions of the Document.
No Content transmitted to the Customer or Buyer, by any means of communication (electronic, telephonic, etc.) or acquired by the Customer or Buyer by accessing, viewing and/or viewing shall constitute a contractual obligation on the part of MobilierModern.RO and/or the employee/employee of MobilierModern.RO who arranged the transfer of the Content, if any, with respect to such Content.
The use or reproduction of any of the elements listed above, without the prior written consent of S.C. NOARIM GROUP S.R.L., is punishable under the laws in force.
Any attempt of any kind to modify the image and information on this website https://mobiliermodern.ro, except by its legal owner – S.C. NOARIM GROUP S.R.L., without the prior consent of S.C. NOARIM GROUP S.R.L., gives S.C. NOARIM GROUP S.R.L. the unilateral and unequivocal right to make use of all its prerogatives to address the legally competent courts to sanction these facts.
Any use of the Content for purposes other than those expressly permitted by this Document or the accompanying User Agreement, if any, is prohibited.

7. PRIVACY AND PERSONAL DATA PROCESSING POLICY
S.C. NOARIM GROUP S.R.L. is registered with ANSPDCP (National Authority for the Supervision of Personal Data Processing) under number 19860.
S.C. NOARIM GROUP S.R.L. certifies that it will respect the rights conferred by Law no. 677/2001 for the protection of individuals with regard to the processing of personal data and the free movement of such data. MobilierModern.RO complies with EU Regulation 2016/679 (GDPR) and any other applicable legislation in Romania.
S.C. NOARIM GROUP S.R.L. guarantees the security and confidentiality of the data hosted and transmitted through its computer system. This information may be used by S.C. NOARIM GROUP S.R.L. for the following purposes:
-to facilitate customer access to MobilierModern.RO services:
a) creation and administration of the account within the MobilierModern.RO platform
b) validation, dispatch and invoicing of orders to the customer
c) subsequent to the validation of the order, for the transmission of information on products, delivery periods, cancellations or other issues of any nature relating to an order or contract, services or products purchased by the customer
d) the return of products according to legal provisions
e) providing support services, including providing answers to questions regarding orders or MobilierModern.RO products and services. These services may include sending newsletters and/or periodic alerts, electronically, by telephone or by post
(f) statistical purposes, without the fundamental rights and freedoms of the customer being affected
h) improvement of MobilierModern.RO services and marketing purposes: by e-mail, SMS, telephone, mobile push, webpush, etc., containing information on the current MobilierModern.RO offer, information on products added to the “wish list” / “my basket” section.
Any MobilierModern.RO customer has the right and freedom to withdraw consent to data processing by:
– Changing settings in your customer account
– Accessing the unsubscribe link displayed within the messages you receive from us
– Contact MobilierModern.RO by email office@mobiliermodern.ro with a written and dated request, or by phone 0316 300 830*.
According to Law no. 677/2001, you have the right of access, the right to intervene on data, the right not to be subject to an individual decision and the right to take legal action. You also have the right to object to the processing of your personal data and to request the deletion of your data*.
In accordance with the requirements of Law no. 677/2001 on the protection of individuals with regard to the processing of personal data and the free movement of such data, as amended and supplemented, and Law no. 506/2004 on the processing of personal data and the protection of privacy in the electronic communications sector, S.C. NOARIM GROUP S.R.L. is obliged to administer safely and only for the specified purposes, the personal data that you provide us about yourself, a member of your family or another person. The purposes of data collection are: advertising, marketing and publicity as well as electronic communication services. You are required to provide the data, as it is necessary for commercial communications, delivery of products and issuing of tax documents. Your refusal makes it impossible for us to deliver your products.
By submitting information or materials through this site, you grant the Seller – S.C. NOARIM GROUP S.R.L.- unrestricted and irrevocable access to them, the right to use, reproduce, display, modify, transmit and distribute such materials or information. You also agree that the Seller – S.C. NOARIM GROUP S.R.L.- may freely use, for its own purposes, these ideas, concepts or techniques that you have sent us via the website www.MobilierModern.RO.ro. S.C. NOARIM GROUP S.R.L. will not be subject to any obligations regarding the confidentiality of the information submitted, unless otherwise specified by the legislation in force.
By reading the Document, you are aware that you are guaranteed the rights provided by law, namely the right to information, the right of access to data, the right to intervene, the right to object, the right not to be subject to an individual decision, the right to apply to the courts in case of violation of the rights guaranteed by Law 677/2001 for the protection of individuals with regard to the processing of personal data and the free movement of such data.
MobilierModern.RO may also provide the Buyer’s personal data to other companies with which it has a partnership relationship, but only on the basis of a confidentiality undertaking from them, guaranteeing that this data is kept secure and that the provision of this personal information is in accordance with the legislation in force, as follows: providers of marketing, courier, payment/banking services, telemarketing or other services, provided by companies with which we may develop joint programmes for offering our Goods and Services on the market, insurers.
We are improving our products, services and promotion by using Microsoft Clarity to analyse user behaviour on the site. By accessing the site, you agree that MobilierModern.RO and Microsoft may collect and use this data. You can find more details in Personal Data Protection.
By filling in the order form on the Site with personal data, including CNP, for the purpose of credit activity, the Buyer expressly consents that the legal entities with which MobilierModern.RO has entered into partnerships in order to offer products by credit (including BRD Finance IFN S.A.) to process his personal data in their records for the purpose of credit analysis and to transmit them for consultation of the information registered in the name of the Buyer in the database of the Credit Bureau.
The Buyer’s personal information may also be provided to the Public Prosecutor’s Office, the Police, the courts and other authorized state bodies, based on and within the limits of the legal provisions and following expressly formulated requests.
The request for deletion of personal data can be made if:
-data is no longer needed for the purposes for which it was collected or you have withdrawn your consent
Retention of personal data:
Personal data is to be stored by MobilierModern.RO as long as you have an account on the MobilierModern.RO platform. You can request the deletion of certain information or your account at any time.
8.COOKIE USE POLICY ON WWW.MobilierModern.RO.RO
This policy covers cookies and similar technologies used as appropriate on the https://mobiliermodern.roși website in the MobilierModern.RO mobile application.
Cookies are used for the following purposes:
- of the website
- improving the customer experience on the site (e.g. content tailored to user preferences – product and service categories)
- for advertising (e.g. measurement, optimization and analytics features – how a user gets to the site)

MobilierModern.RO uses two types of Cookies: per session and fixed (temporary files that remain in the user’s terminal until the session ends or the web application/browser is closed). Fixed files remain on the user’s terminal for a period of time within the cookie settings or until they are manually deleted by the user.

The customer has the right to object to the collection of his personal data and to request its deletion, thereby revoking his consent to the document, and thereby waiving any implied right specified therein and without any further obligation of either party to the other or without either party being able to claim damages from the other. For this, the Customer or Buyer shall contact MobilierModern.RO, according to the contact details available on the website, valid at that time. Using the forms available on the website, the Customer or the Buyer has the right to amend the data they originally declared to reflect any changes, if any. MobilierModern.RO undertakes that the data collected from the Buyer/Customer shall only be used in accordance with the stated purposes and shall not make public, sell, rent, license, transfer, etc. the database containing information relating to the personal or special data of the Buyer/Customer to any third party not involved in the fulfilment of the stated purposes. An exception to the above-mentioned provisions will be made when the transfer/access/display/etc. is requested by the competent authorities in the cases provided for by the regulations in force at the time of the event. MobilierModern.RO shall not be liable for any failure that may endanger the security of the server on which the database containing this data is hosted.
9. ADVERTISEMENT
All commercial messages sent on behalf of MobilierModern.RO (such as: newsletter, sms, mobile push, etc.) are sent through partners specialized and approved by MobilierModern.RO. This ensures confidentiality and security of information.
The Customer or Buyer may opt out of receiving commercial messages at any time:
- using the dedicated link in any Newsletter
- by sending an SMS with the text “DZB SMP” (without quotation marks) to the short number 1846 (In accordance with ANCOM regulations – National Authority for Administration and Regulation in Communications, SMS sent to short numbers are charged to the mobile phone user by the operator at the normal rate – 0.05 EUR / SMS. The short numbers are open for SMS traffic on the Vodafone Romania, Orange Romania, Telekom Romania Mobile (formerly Cosmote Romania), Orange Romania Communications (formerly Telekom Romania Communications) and DigiMobil (RCS&RDS) networks.

10. RIGHTS AND OBLIGATIONS OF THE SELLER S.C. NOARIM GROUP S.R.L.
The seller will use his professional and technical knowledge to achieve the result stipulated in the order and will deliver goods and services that meet the buyer’s requirements, needs and specifications;
The information presented on the seller’s websites is for information purposes only and may be changed by the seller without prior notice. Also, for reasons of space and consistency of information structure, product descriptions may be incomplete, but the seller makes an effort to present the most relevant information so that the product is used in the parameters for which it was purchased. Product images are also for information purposes only and there may be differences between them and the product;
Communicating with the shop – can be done by interacting with the shop, posting opinions about products or communicating through the addresses mentioned in the “Contact” section. Opinions or addresses containing insults or inappropriate language will be excluded from the site or ignored. The seller is free to handle the information received without having to justify it.
S.C. NOARIM GROUP S.R.L. may assign and/or subcontract a third party for services related to the fulfilment of the order, with the Buyer’s information, without the Buyer’s consent. The Seller will always be liable to the Buyer for all contractual obligations (choice of delivery company).
11. TRANSFER OF OWNERSHIP
The ownership of the Goods and Services will be transferred at the time of payment by the Buyer at the location indicated in the order (understanding by delivery – the signature of receipt of the transport document provided by the courier or the signature of receipt on the fiscal invoice in case of deliveries made by S.C. NOARIM GROUP S.R.L. staff).
The customer has the obligation to check the packaging for tears, scratches, dents and may refuse the product if it shows signs of mishandling and to conclude a report with the courier company representative.
12. DELIVERY OF GOODS
The Seller undertakes to deliver the Goods by door-to-door courier to the Buyer or to MobilierModern.RO’s showrooms, at the Customer’s option.
The Seller shall ensure proper packaging of the Goods and shall ensure the transmission of the accompanying documents.
The Seller shall deliver the Goods and Services only within Romania.
Delivery is 24.99 RON * (For localities outside the courier’s coverage area, a transport cost will be charged, calculated according to the number of additional kilometres. This cost appears automatically on the order page when the order is placed on the website) for all orders, regardless of value, that are NOT BULK PRODUCT.
Delivery is 189 RON for Bulky Products ( in the product page it is explicitly mentioned “Bulky product that can only be delivered by premium delivery with 2 people, until after the first door of the house” ).
In the case of a registered and paid order, including this shipping cost, for logistical reasons, we reserve the right to deliver the products by courier company SMP Courier, Gebruder Weiss or DPD.
Throughout Romania (except Bucharest-Ilfov and Cluj), the delivery of products is free if the order value exceeds the threshold of 149 RON. If the destination address is outside the courier’s coverage area, an additional mileage charge of RON 1.3/km will be levied.
13. ACCEPTANCE
Acceptance will be made when the goods and services conform to the technical characteristics mentioned in the order. If the buyer discovers that the goods delivered or services provided do not conform to the technical specifications, then the seller will bring the goods and services into conformity.
To resolve complaints, product packaging must be retained until the complaint is resolved. Also, when sending the complaint, it must be sent together with pictures of the labels on the packaging of each product. Also, for products sold and delivered by S.C. NOARIM GROUP S.R.L., through the website https://mobiliermodern.ro, the Buyer is entitled to return the products within 14 days. For some of the products, the return period is longer and is indicated on the product presentation page. Regardless of the deadline for returning the product, the customer is obliged to report in writing to clienti@MobilierModern.RO.ro any defects or missing components within a maximum of 5 days after receipt of the products. When the customer receives the product, he is obliged to check the integrity of the parcel packaging in the presence of the courier. If the parcel is damaged on delivery, the customer is obliged to refuse to accept it and to specify in the comments of the report concluded with the courier agent the condition of the parcel at the time of delivery.
The customer is obliged to check the integrity of each element before assembly and not to assemble the product if he finds defects in the product or elements of the product. Assembly of the product under these conditions will result in loss of warranty.
14. PRODUCT WARRANTY
All products sold by the website www.MobilierModern.RO.ro, benefit from warranty conditions according to the legislation in force and the commercial policies of the manufacturers. The products are new, in their own packaging and come from sources authorised by each individual manufacturer. Some of the products may be placed in the category of resealed products, with the reason for resealing explicitly listed on the product presentation page of each product.
All products sold and delivered are accompanied by a warranty certificate issued directly by S.C. NOARIM GROUP S.R.L. The warranty certificate contains general instructions for use and warranty conditions.
The guarantee certificate and related documents are issued in electronic format only and are available for download in the customer account or can be requested by calling 0316 300 830 or by e-mail clienti@MobilierModern.RO.ro .
The buyer is obliged to keep the guarantee certificate and the tax invoice. In the event of a defect, according to Law no. 449/2003, the guarantee certificate is the only document proving the right to the guarantee and must be presented together with the tax invoice and proof of payment (receipt, tax voucher, etc.). Loss of the warranty certificate shall invalidate the warranty of the Goods or Service.
The Guarantee of Goods, which benefit from the Guarantee Certificate issued by S.C. NOARIM GROUP S.R.L., shall be settled at the company’s head office on str. Electrolizei nr.60, loc. Baia Mare, Maramures county.
The guarantee conditions are in accordance with O.G. 21/1992, Law 449/2003 and O.G. 174/2008.
For any category of products are strictly prohibited:
-reassembly of the product if damage to an element or the product itself is found;
– unpacking using sharp or hard objects;- cutting or scratching materials;- rubbing against other surfaces or with abrasive substances (cleaning solutions);- using or storing products in damp environments or at temperatures below 0 degrees Celsius as well as in environments with temperature variations;- placing the product near heat sources (the distance between the product and the heat source is 1 m), apart from kitchen furniture designed for this purpose; – using cleaning products containing acids, oil, gas, detergents, chemical solvents or alcohol (any solution must first be tested on a small, concealed surface);- dehydration of the skin (without hydration the skin dries out and cracks);- wetting of products (clean with a cloth lightly dampened in a solution of soapy water – 50% water, 50% pH neutral liquid soap – then wipe immediately with a dry cloth);- pushing furniture (furniture that can be dismantled must be dismantled);- rolling, bending or curling of mattresses during transport and handling;- using furniture for purposes other than those for which it was designed.
The guarantee is settled within a maximum of 15 calendar days.
15. RETURN POLICY
According to the Romanian legislation you can return products purchased on https://mobiliermodern.ro within 14 calendar days of receipt, without having to justify the return decision and without incurring any costs other than the direct costs of returning the products, in accordance with Ordinance No. 34/2014 on consumer rights in contracts with professionals.

You can return products purchased from https://mobiliermodern.ro within 14 calendar days of receipt.
The return form must be completed no later than the last calendar day of the return period listed on the product presentation page of the purchased product on www.MobilierModern.RO.ro. The return period starts from the date of receipt of the product. Forms completed after this period are no longer valid.
If the pick-up address is outside the courier’s coverage area, an additional kilometre charge of 1.3 lei/km will be levied.
GENERAL RETURN CONDITIONS
Products must be returned in new condition and accompanied by all accessories (including hardware), original documents (tax invoice, tax receipt, technical data sheet, user manual, warranty certificate), well packaged and protected during transport.
If the returned product is damaged, has stains, shows signs of assembly, wear or excessive use, scratches, chipping, dents, mechanical shocks, is dirty or has missing hardware and cannot be resold as a new product, a fee will be charged to cover the difference in price between a new product and a product already used.
The money will be returned within 14 days from the date of the return decision to the bank account provided by the customer in the return form. In the case of purchases made in instalments with one of the partner banks’ shopping cards, the money will be refunded exclusively to the card with which the instalment purchase was made.
Products offered as gifts must also be returned in new condition. Otherwise, they will be invoiced at the price displayed on our website www.MobilierModern.RO.ro and their value will be deducted from the difference to be refunded.
In the event of the return of products which have benefited from the assembly service, if the Buyer has given his express prior consent to the assembly service, the costs paid for the assembly will not be refunded.
Products made to order cannot be returned. These products have been made especially for you. By custom-made products we mean any product that has been customized according to the customer’s preferences (size: length, width, height; surface material – by specifying a material code or any other modification to the standard model presented on the product page of the website www.MobilierModern.RO.ro), according to Article 16, point c, of Emergency Ordinance no. 34/2014.
In the case of returned mattresses and extra mattresses that have been removed from the TNT test cover or do not have a test cover, a charge of 30% of the value of the mattress will be levied to cover the cost of reupholstering.
Products intended for intimate personal use that have been removed from their original packaging: protective covers, pillows, pillowcases, bed linen, may NOT be returned.
Please note: If you have bought several products of the same kind and want to return them all, only one of the products can be unsealed, the rest of the products can only be accepted if they are sealed.
PRODUCT VERIFICATION
Upon receipt of the parcel, please check the integrity of the packaging. If the packages are damaged in their packaging at the time of receipt, it is mandatory to conclude a Minutes with the agents of the courier company, SMP Courier, Gebruder Weiss or DPD, in which the delivery with damaged packaging is noted or to refuse receipt as specified in point 13.
In the case of products that have the option “open parcel on delivery” displayed on the product page, it is mandatory to check the products in full at the time of delivery. For these products, signing the transport documents implies acceptance of the products and their quality. Any subsequent claims regarding possible damage to the products due to transport are void.
RETURN OF DEFECTIVE PRODUCTS
If you return a product which has a manufacturing defect or a defect which has arisen as a result of transport, it must be returned under exactly the same conditions as the other products covered by this Regulation (except for the return tax).
In the case of damaged products, replacement (of the item or product, as appropriate) will be offered. If the replacement of the item or product is refused and the return is opted for, then the return fee will be retained.
If the returned product has any other defects than those noted on the return form (e.g. stains, marks from assembly, wear or excessive use, scratches, chipping, dents, mechanical shocks, dirty or missing hardware), a fee of 30% of the value of the product will be charged or if it is in a condition that does not allow us to remarket it we reserve the right to refuse the product.
Please note: Products whose defects are found after a period of time longer than the return period displayed on the product presentation page cannot be returned. In this case the defects reported will be dealt with in accordance with the terms and conditions stated in the Product Warranty Certificate.
Dissatisfaction with the appearance, colour or texture of the material does not constitute a product defect.
You are responsible for the integrity of the products during transport of the returned products:
The consumer is liable only for the diminished value of the products resulting from their handling, other than what is necessary to determine the nature, characteristics and functioning of the products, according to Article 14(3) of Emergency Ordinance No 34/2014.
*A report is drawn up upon receipt of the returned product and photographs are taken to prove the reduction in value (if applicable).
PACKAGING RECOMMENDATIONS
In order to protect the product during transport, we recommend that you observe the following packaging instructions:
PACKAGING OF MATTRESSES
We recommend packing the mattresses in nylon film with a minimum thickness of 0.18 mm. The edges of the foil should be sealed tightly with packaging tape to protect the product from dust. For products weighing more than 40 kg, it is recommended to use a textile bag (like the one in which the product was shipped to you) with sewn ends to protect the product against possible damage due to handling during transport.
PACKAGING OF FURNITURE PRODUCTS
We recommend packing products in this category in cardboard boxes and protecting them further on the outside with bubble wrap. Over this foil, as an additional protective measure, use packaging tape – scotch tape.
PACKAGING OF LIGHTING PRODUCTS

PACKAGING OF PRODUCTS IN THE DECORATION CATEGORY

PACKAGING OF ARMCHAIRS, SOFAS AND CUSHIONS
We recommend packaging the products in this category in strech film to protect the product against dust and bubble wrap to protect the products against possible damage due to handling during transport.
16. MAJOR FORCE
Neither party shall be liable for non-performance of its contractual obligations if such non-performance is due to an event of force majeure. Force majeure is an unforeseeable event beyond the control of the parties and which cannot be avoided.
If within 15 (fifteen) days from the date of the occurrence of the event, the said event does not cease, each party shall be entitled to notify the other party of the full termination of the Contract without either party being entitled to claim any further damages.
17. APPLICABLE LAW
This contract is subject to Romanian law. Any disputes arising between MobilierModern.RO and the Customers/Buyers shall be settled amicably or, if this is not possible, the disputes shall be settled by the competent Romanian courts in the Municipality of TÂRGU JIU.
